Terms & Conditions
Welcome to the Down Quilt House website which is operated from our registered office at 4, Dower House Square, Bawtry, Doncaster, DN10 6LS, England. This website is wholly owned by Down Quilt House. Use of this website is governed by the terms and conditions set out below. ‘Customer’ is the person referred to as the buyer who is purchasing the goods.
1.1. Prices are quoted in British pounds inclusive of VAT.
1.2. Postage and packing costs can be found here.
2.1. Online payment using PAYPAL or DEBIT OR CREDIT methods of payment. Payment to be made in pounds sterling.
2.2. The following credit cards can be used: VISA, SWITCH, MASTER CARD, MAESTRO, DIRECT DEBIT.
- Retention of Title
Title of the invoiced goods will only pass to the customer once full payment of the invoice is received.
4.1. UK - recorded delivery: Monday to Friday only. Please allow 3-5 working days for delivery. Down Quilt House will acknowledge on receipt of order if there is any change to the delivery period.
4.2. Product unavailability will be acknowledged as soon as possible and money refunded.
4.3. Down Quilt House is not responsible for any lost order by a third party once the goods have left Down Quilt House’s registered premises. If the received goods are damaged, a refund or exchange will be accepted only if the goods are returned within 14 working days from the signed receipt of the goods, with the original packaging to our registered office.
4.4. Packaging - every effort will be made to pack the goods as advised in our packaging section. However, Down Quilt House reserves the right to send the goods in alternative suitable secure packaging if necessary.
- Returned goods and cancelled orders
5.1. Down Quilt House will only accept returned goods if the customer complies with clause 5.
5.2. Customers are entitled to a full refund or exchange if they return goods in their original condition within 28 days of receipt.
5.3. Down Quilt House does not cover shipping costs for returns. The cost of shipping returns must be covered by the customer.
5.4. Down Quilt House cannot be held responsible for goods sent by a customer which are lost in transit.
5.5. If an order is cancelled after it has been dispatched, the return procedure outlined in clause 6 will apply. If the procedure is not adhered to, the order will be deemed valid and the customer liable for full payment.
5.6. All returned goods must be returned in the original packaging to ensure goods are not damaged in transit.
5.7. Goods that arrive in a faulty or damaged state should be returned within 30 days to receive a replacement or refund. In some cases the company may accept images of the fault in lieu of return of the item. This is at the company's discretion.
5.8. Items which develop a fault within the first 6 months of purchase should be returned for inspection, after which you may be entitled to a replacement or refund. In some cases the company may accept images of the fault in lieu of return of the item. This is at the company's discretion.
- Product acceptance
The customer shall inspect the goods and notify Down Quilt House within 14 working days from receipt of goods if there is a reason for rejection. If notification is not received within 14 working days, Down Quilt House will assume the goods are satisfactory and any rejection will not be acceptable beyond this period. This does not affect the customer’s statutory rights.
- Force Majeure
Down Quilt House shall not be liable to the customer for any loss or damage which may be suffered by the customer as a direct or indirect result of the supply of Goods by Down Quilt House being prevented, hindered, delayed or rendered uneconomic by any cause whatsoever beyond Down Quilt House’s control and in particular but without prejudice to the generality of the foregoing by Act of God, war, riot, civil commotion, Government controls restrictions or prohibitions or any other Government act or omission whether local or national, fire, flood, subsidence, sabotage, accident, breakdown of plant or machinery, strike or lock out, trade dispute or labour disturbance or difficulty or increased expense in obtaining labour, materials, or transport or other circumstances affecting the supply of Goods or raw materials by Down Quilt House’s normal source of supply or the manufacturer of the Goods, or the delivery of Goods by Down Quilt House’s normal route or means of delivery.
- Severance and Waiver
8.1. In the event of any part of these conditions being ineffective for any reason, the remainder thereof shall constitute the conditions binding upon the parties.
8.2. Failure or neglect by Down Quilt House to enforce at any time any of the provisions hereof shall not be construed as, nor be deemed to be, a waiver of Down Quilt House's rights hereunder, nor shall such failure or neglect in any way affect the validity of the whole or any part of these terms and conditions and Down Quilt House’s' right to take subsequent action shall not be prejudiced thereby.
9.1. All data received is processed and managed in accordance with the Data Protection Act 1998. Down Quilt House retains this information on a secure server. Credit card details are not retained.
9.2. Down Quilt House will never request credit card details by email. If this request is made claiming it is from Down Quilt House, do not respond and advise Down Quilt House immediately.
- Legal notice
10.1. Down Quilt House reserves the right to amend, delete and alter any terms and conditions without notice. Updated conditions of sale will be immediately published once these changes have been made.
10.2. Down Quilt House reserves the absolute right to amend, modify or withdraw, temporarily or permanently the Down Quilt House website without notice.
10.3. All rights including copyright in this website are owned or licensed by Down Quilt House. Modification, distribution and reposting any material on this website are strictly prohibited.
- Marketing literature
Unless the appropriate box is ticked, marketing literature will be sent to the customer. This will be sent via email advising you of new products, special offers or promotions.
12.1. Down Quilt House makes every reasonable effort to ensure that the information provided, namely goods description, colour of goods and general marketing materials, is accurate. Down Quilt House does not provide warranties to its accuracy or completeness. Moreover, Down Quilt House will not be responsible for any errors or omissions arising from such information.
12.2. Down Quilt House shall not be liable to any person or persons for any loss or damage arising from the use of the information provided on the Down Quilt House website.
12.3. Down Quilt House shall not be liable to any person or persons for loss or damage arising owing to the failure of the customer not protecting their password or account details. All personal data must be accurate and complete including invoice, delivery addresses and postcodes. Any changes must be notified to Down Quilt House immediately.
12.4. Down Quilt House makes all reasonable endeavours to secure the reliable accurate flow of information whilst using the Down Quilt House website. However, Down Quilt House cannot be liable for any misinterpretation, error, disruption, corruption or loss of material when information is downloaded within a computer system.
12.5. Down Quilt House uses its best endeavours to ensure its website has no defects or viruses. Thus Down Quilt House cannot be held responsible for any damage or error arising on the customer’s computer when accessing Down Quilt House’s website.
12.6. The complete and entire liability of Down Quilt House shall not exceed the value of the goods ordered, except as advised in these conditions.
- Legal Interpretation
Any agreement to which these terms and conditions apply shall be governed and construed in accordance with English Law and any dispute arising out of or in connection with such agreement shall be determined by the English Courts.
